Sub:- Request for remove anomaly in promotion for post of Principal.

Sir,

We are glad that our respected Prime Minister Shri Narendra Modi, Chief Minister Shrimati Vasundhara Raje ji and you also are pioneers in providing good governance to people. The effective implementation of rules and providing justice to all, are parts of good governance. Today's news in a leading newspaper stats that the DPC for year 2013-14 for post of Principal is now being held. I request you to implement the rules in right way which are given for this DPC of Principal in Rajasthan Educational Services Rules 1970.

I draw your kind attention towards Rajasthan Educational Service Rule- 1970. In the Rajasthan Educational Service rules of 1970, the different posts of Rajasthan Educational Services are classified into various groups and each group is at different pedestal. So there are different rules for appointment and promotion for different groups. In these rules the 50:50 ratio among group-F posts of lecturer and Head Master (Secondary School) is given for the promotion to the post of group-E ( i.e. the posts which are earlier known as Vice-Principal/ Head Master Higher Secondary School/ Senior Deputy Inspector of School) not for the post of Principal of group D-II of schedule appended to the RES Rules 1970.

Hence the rules provided for the group-E (i.e. vice principal) can not be implemented for Group -D section II (i.e. Principal).

In the rules of 1970, the schedule given under heading "group- D section II", the column number 5 stats that the promotions on the posts of principal will be from the posts of group E &  F but no ratio between E & F is prescribed in the schedule. The procedure for making seniority list for the promotions to the posts of Group D-II is provided in rule 28 sub rule 7 of RES 1970 which states that--

Rule 28 (7) of Seniority:

"(7) that the common seniority of persons appointed to posts mentioned in Group ‘E’ and ‘F’ for promotion to the posts in the Group ‘D’ [ ] shall be determined with reference to the date of their substantive appointment. The inter-se seniority of persons selected by the Commission or Committee shall be as indicated by the Commission or Committee. Inter Se seniority of persons selected against departmental promotion quota shall be determined under rules 24 and 25."                          
Now again I would like to request you that the 50-50% Ratio is mentioned only in "Group– E" i.e. for the promotion to the posts of Headmaster Higher Secondary School which was earlier also known as Vice Principal and Senior Deputy Inspector of School.

Therefore it is crystal clear that the promotion for the post of Principal (group-D), which were made earlier in the DPC of year 2012-13 by 50-50% ratio among Lecturers and Head Master Secondary School, are not according to the rules of 1970. I respectfully submit that the rules which are implemented without any notification of the honourable Governor, are said to be arbitrary and unjust. So the rule of putting 50:50 ratio between lecturers and Head Master Secondary Schools (i.e. group F ) for the promotion to posts of Principals(group-D),  seems to be unjust and arbitrary. So kindly examine this issue before doing DPC of year 2013-14 and take an appropriate action.
